General Terms and Conditions of Sale

§ 1 Scope of Application These General Terms and Conditions of Sale (GTC) apply to all contracts concluded between Clouds Ecom Limited, 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom (hereinafter the “Provider”) and the customer, concerning the assistance service offered on this website for applying for an Electronic Travel Authorization (eTA) for Canada.

§ 2 Subject Matter of the Contract The Provider is a private company and is in no way affiliated with the Canadian government or any official authority. The Provider offers a paid service consisting of the verification, completion, and transmission of the information provided by the customer for the purpose of submitting an eTA application to the competent Canadian authority.

The eTA can also be applied for directly and free of charge on the official website of the Canadian government. The fee charged by the Provider covers exclusively the assistance service and does not include any official fees that may be collected separately by the Canadian government.

§ 3 Conclusion of the Contract The presentation of the service on the website does not constitute a binding contractual offer, but an invitation to the customer to submit an offer. By submitting the completed form and confirming payment, the customer makes a binding offer to conclude a service contract. The contract is concluded upon receipt of confirmation by the Provider.

§ 4 Prices and Payment The applicable prices are those indicated on the website at the time of the order. Payment is made using the payment methods offered on the site.

§ 5 Performance of the Service After receipt of payment, the Provider processes and transmits the information provided by the customer to the competent Canadian authority. The processing time as well as the final decision regarding the issuance of the eTA fall exclusively under the responsibility of the competent Canadian authority. The Provider has no influence on this process and does not guarantee either the issuance or the processing time of the eTA.

§ 6 Liability The Provider is liable without limitation in the event of intent or gross negligence, as well as in accordance with mandatory legal provisions. In the case of slight negligence, the Provider is only liable in the event of breach of a material contractual obligation; in such a case, liability is limited to foreseeable and typical damage under the contract. The Provider is not responsible for the accuracy of the information provided by the customer, nor for decisions taken by Canadian immigration authorities.

§ 7 Final Provisions If any provision of these GTC is or becomes invalid, the validity of the remaining provisions shall not be affected.
